Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Awaaz WhatsApp Business Platform at https://app.aawaz.ai (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Awaaz provides software tools to help businesses manage WhatsApp Business messaging via Meta’s WhatsApp Cloud API, including live chat, contacts, templates, campaigns, team access, and related features. Features may change over time as we improve the product.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
If you invite team members, you are responsible for the access you grant and for ensuring they comply with these Terms.
3. Meta and WhatsApp requirements
The Service depends on Meta / WhatsApp Business Platform. You must comply with:
- Meta’s terms, policies, and WhatsApp Business / Commerce Policies
- Applicable messaging, spam, and consumer-protection laws
- Opt-in and consent requirements before messaging end customers on WhatsApp
We are not responsible for Meta outages, policy enforcement, phone number restrictions, template rejections, or account bans applied by Meta. Connecting your WhatsApp Business account authorizes us to use Meta APIs on your behalf as needed to operate the features you use.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or abusive messaging
- Send spam or unsolicited bulk messages in violation of WhatsApp policies
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or other users
- Reverse engineer or resell the Service except as expressly permitted
- Misrepresent your identity or your relationship with Meta or WhatsApp
We may suspend or terminate access if we reasonably believe you have violated these Terms or applicable policies.
5. Customer data and content
You retain ownership of content and data you submit to the Service, including messages and contacts (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service.
You represent that you have all rights and consents needed to process Customer Data through Awaaz and WhatsApp. Our handling of personal data is described in our Privacy Policy.
6. Fees and billing
Some features may require a paid subscription. Fees, plan limits, and billing terms will be presented at purchase or in your billing settings. Except where required by law, fees are non-refundable. WhatsApp / Meta conversation and messaging fees charged by Meta are separate from Awaaz subscription fees and are your responsibility under your Meta / WhatsApp billing arrangement.
7. Intellectual property
Awaaz, including its software, branding, and documentation, is owned by us or our licensors. These Terms do not grant you any ownership rights in the Service. Feedback you provide may be used by us without obligation to you.
8. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with or without notice where reasonably necessary for maintenance, security, or product evolution.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT RESULTS FROM USE WILL BE ACCURATE OR RELIABLE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAZ AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO AWAZ FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Awaaz and its affiliates from claims, damages, and expenses arising from your use of the Service, your Customer Data, your messaging practices, or your violation of these Terms or Meta / WhatsApp policies.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law or Meta, or if we discontinue the Service. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including liability limits and indemnity) will survive termination.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws applicable in India, without regard to conflict-of-law principles, unless mandatory local consumer law provides otherwise. Courts in India shall have exclusive jurisdiction over disputes, subject to any non-waivable rights you may have.
